Holly Logan represents clients in a wide variety of white collar criminal prosecutions and investigations as well as civil and regulatory government proceedings. Holly also handles a broad array of business litigation. In just over a decade of practice, she has handled a multitude of criminal and civil cases in federal and state courts and before administrative agencies. She has also represented and counseled professionals (accountants, attorneys, physicians) in litigation and other administrative proceedings.
Accolades and Achievements
Holly has tried over a dozen criminal and civil cases. She has argued appeals before the Iowa Supreme Court and the Iowa Court of Appeals and briefed several appeals to the United States Court of Appeals for the Eighth Circuit. She has successfully tried a number of “bet the company” civil cases and high-profile criminal cases over the years. Most recently, she successfully defended a farm corporation at trial against a minority shareholder’s suit for corporate dissolution. Holly’s client won judgment as a matter of law following plaintiff’s presentation of his case.
Holly and law partner Mark Weinhardt have won a number of courtroom victories, and clients often note their complementary work styles and approach to cases. In 2010, Holly and Mark won the acquittal of Postville packing plant executive Sholom Rubashkin against 83 counts of violating Iowa’s child labor laws in a five-week jury trial. The two also won an acquittal following a two-week jury trial for a Des Moines cardiologist charged with 28 counts of violating federal insider trading laws. In civil court, Holly and Mark successfully defended a heavy equipment manufacturing business and its owner against myriad tort and contract claims from the minority owner. They counterclaimed and won compensatory and punitive damages for their clients. A victory for a technology client in a “Markman” claim construction hearing in a patent case led to the favorable settlement with the client’s international competitor.
Since the beginning of her career, Holly has been devoted to providing pro bono assistance to indigent persons. She has served on the Board of Directors of the Polk County Volunteer Lawyers Project (“VLP”) since 2004 and just completed a two year term as President of the Board from 2009 to 2011. Holly received the VLP’s Outstanding Volunteer Award in 2009 and 2011. She received the 2011 award for volunteering more than 200 pro bono hours through the Hispanic Outreach Legal Assistance Clinic and for providing leadership to the VLP Board of Directors.
Criminal Practice
Holly’s white collar criminal practice includes the defense of individuals, companies, and boards of directors. She has extensive experience representing clients, including targets and subjects, in all phases of government investigations and at trial. She has represented numerous clients in federal grand jury investigations in Iowa and throughout the United States.
Recent criminal cases Holly has handled include antitrust, bank fraud, mail and wire fraud, embezzlement, money laundering, insider trading and other securities violations, health care fraud, false statements to the government, vote fraud, food safety, arms exports, tax evasion, agricultural lending and insurance, immigration fraud, environmental crime, identity theft, labor law violations, and public corruption.
Holly has represented clients in a wide variety of industries in matters involving the Department of Justice and Federal Bureau of Investigation. In addition, she has handled investigations conducted by governmental agencies as diverse as the Securities and Exchange Commission, Food and Drug Administration, Secret Service, U.S. Customs Service, Federal Deposit Insurance Corporation, Environmental Protection Agency, Internal Revenue Service, U.S. Department of Agriculture, U.S. Postal Inspection Service, U.S. Department of Homeland Security, U.S. Immigration and Customs Enforcement, U.S. Department of Defense, and the U.S. Department of Labor.
Civil Practice
In the area of civil litigation, Holly has represented companies, their owners, and their officers and directors in lawsuits involving corporate control and governance (e.g., suits between minority and majority shareholders), breach of contract, various business torts, and allegations of breach of fiduciary duty. She has litigated cases involving patent infringement, trade secrets, false advertising, consumer fraud and securities fraud, as well as dealer/franchise/agency terminations.
Holly has litigated health insurance issues and media issues including defamation cases and open records disputes. She has also litigated employment law issues of noncompetition and nonsolicitation agreements and claims of discrimination, retaliation, and wrongful termination. Earlier in her career Holly devoted more of her time to the practice of employment law, and she was recognized by Chambers and Partners for blending her “detailed, go-getting approach” along with her “calm and collected manner.” Chambers and Partners USA, The Client’s Guide, 2006.
History
Before founding Weinhardt & Logan, P.C., Holly practiced for 10 years at Belin McCormick, P.C., a full service law firm in Des Moines. She became an equity member of that firm in 2005. She served on the firm’s management committee and served as its corporate secretary in 2011.
Holly was born in Bloomfield, Iowa. She earned a full-ride NCAA Division I athletic scholarship from the University of Dayton. She graduated magna cum laude from the University of Dayton in 1998 with a Bachelor of Science in Business Administration (Finance) degree. She earned her law degree with high distinction from the University of Iowa College of Law in 2001, where she also served as Note and Comment Editor of the Journal of Corporation Law from 1999 to 2000.
Holly worked at the Davis County Attorney’s office following her first year of law school. She got to try cases and go to court regularly with the county attorney. That experience ignited her passion for criminal law and love of trying cases.
